1. Agreement and Acceptance

These Terms of Service ("Agreement") govern the legal relationship between the Ezan ve Dua mobile application ("App") users ("User", "you") and the Ezan ve Dua Development Team.

By downloading, installing, creating an account, or using the App in any way, you represent and warrant that you have read, understood, and accepted all provisions of this Agreement. If you do not accept these terms, do not use the App.

2. Description of the App

Ezan ve Dua is a comprehensive mobile application designed to support Islamic daily practices. Key features include:

• Prayer time calculation and notifications
• Adhan sounds (with various muezzin options)
• Qibla direction finding (compass)
• Quran reading (Mushaf)
• Khatm tracking (personal and group)
• Dhikr and tasbih counter
• Dua (supplication) collection
• Fasting tracking
• Hifz (memorization) practice and recitation evaluation
• Zakat calculator
• Gamification system (XP, Nur, badges, levels)
• Family worship network
• Seyr (discovery) content feed
• Vefa memorial pages
• Bereket Map (halal venue guide)
• Community features (dua requests, community support)
• AI-powered Islamic advisor
• Special modes (Ramadan, Hajj, Umrah)

The App is distributed through Apple App Store and Google Play Store.

3. Account Creation and Security

3.1. Account Types

• Anonymous account: Automatically created when you first open the App. No personal information is required.
• Permanent account: You can convert your anonymous account to a permanent one using email/password or Sign in with Apple methods.

3.2. Responsibilities

• You are responsible for the security of your account information.
• You must keep your password secure and not share it with others.
• You are responsible for all actions performed through your account.
• You must immediately notify help@ezanvedua.com if you notice unauthorized access to your account.

3.3. Age Requirement

You must be at least 13 years old to use the App.

4. Usage Rules

4.1. Acceptable Use

You may use the App only for personal, non-commercial purposes, in compliance with the following rules:

• Comply with all applicable laws
• Abide by all provisions of this Agreement
• Respect the rights of other users
• Act respectfully toward Islamic content and values

4.2. Prohibited Conduct

The following behaviors are strictly prohibited:

(a) Content violations: - Sharing obscene, insulting, hate speech-containing, or unlawful content - Sharing content that insults or disrespects Islamic values, the Holy Quran, prophets, or other religions - Spreading misleading, unverified, or intentionally false religious information - Sharing others' personal information without authorization - Sharing spam, advertisements, or unsolicited commercial content

(b) Technical violations: - Attempting to reverse engineer the App's source code - Attempting to bypass, disable, or test the App's security mechanisms - Accessing the App using automated tools, bots, or crawlers - Performing actions that overload servers or disrupt service - Manipulating the anti-cheat system to obtain unfair points or rewards

(c) Account violations: - Creating multiple accounts to abuse the gamification system - Accessing another person's account without authorization - Selling, transferring, or renting your account

4.3. Violation Sanctions

If you violate the above rules, we may, at our sole discretion:

• Send a warning
• Remove shared content
• Temporarily or permanently suspend your account
• Delete your account

5. Intellectual Property Rights

5.1. App Content

All intellectual property rights in the App's design, source code, graphical interface, logo, icons, animations, sound effects, gamification system, and original content belong to the Ezan ve Dua Development Team and are protected under the Turkish Law on Intellectual and Artistic Works No. 5846 and international intellectual property agreements.

5.2. Holy Quran and Religious Content

• The text of the Holy Quran is the common heritage of humanity and carries no copyright claim.
• Translations and commentaries from the Presidency of Religious Affairs (Diyanet) are used with proper attribution.
• Adhan sounds and nasheed recordings are provided from sources with appropriate permissions or under free licenses.

5.3. User Content

You retain intellectual property rights in content you share through community features (dua requests, bereket reviews, community posts). However, by sharing such content, you grant the Company a limited, royalty-free, revocable license to display, process, and store that content within the App. This license terminates when you delete your account.

6. Premium Subscription and In-App Purchases

6.1. Premium Features

The App offers all core features for free. Premium subscription provides the following additional benefits:

• 2x XP and Nur earning multiplier
• Streak freeze
• Unlimited AI chat
• Advanced statistics
• All translations
• Ad-free experience (the App is already ad-free; this item is reserved for future changes)

Important: Non-premium users are not deprived of any features. Premium only offers additional enhancements to enrich the experience.

6.2. Pricing

• Lifetime Premium: ₺999.99 (one-time payment, not a subscription)

Prices include taxes and are subject to change. The current price is always displayed on the payment screen in the Apple App Store or Google Play Store.

6.3. Payment and Refunds

• All payments are processed through the Apple App Store or Google Play Store payment infrastructure.
• Your credit card or payment information is never seen or stored by us.
• Refund requests are subject to the refund policies of the relevant platform (Apple or Google):

• You can use the "Restore Purchases" option within the App to restore previous purchases.

6.4. Free Trial

New users are offered a 90-day free Premium trial period. No automatic charge is made at the end of the trial period; if you wish to continue Premium, you must manually complete the purchase.

7. Artificial Intelligence (AI) Features

7.1. Scope of Use

The App offers an AI-powered chat feature to answer your questions on Islamic topics. This feature operates on the Anthropic Claude API infrastructure.

7.2. Disclaimer

• AI responses are for informational purposes only; they do not constitute official religious rulings (fatwa), legal advice, or medical advice.
• For definitive rulings on religious matters, we recommend consulting qualified religious scholars or official religious authorities.
• The Company cannot be held responsible for any errors in AI responses.
• Daily AI usage limits may apply (5 messages per day for free users).

7.3. Content Moderation

Content shared through community features is monitored by an AI-powered automatic moderation system. Content found inappropriate may be automatically removed.

8. Location-Based Services

8.1. Usage Areas

Your location information is used for the following services:

• Accurate calculation of prayer times
• Determining qibla direction
• Showing nearby mosques
• Listing nearby halal venues on the Bereket Map

8.2. Limitations

• Location data is obtained only with foreground permission; no background location tracking is performed.
• If you do not grant location permission, you can manually enter your city; in this case, prayer times will be calculated based on your manual entry.
• The accuracy of location data depends on your device's GPS hardware; we accept no responsibility for possible deviations.

9. Prayer Times and Religious Content Accuracy

9.1. Prayer Times

Prayer times are calculated using internationally accepted astronomical calculation methods (Diyanet, ISNA, MWL, Umm al-Qura, etc.) and the adhan library. Calculations are performed on-device and do not require an internet connection.

Limitation of liability: The accuracy of prayer times depends on the precision of your location data, the calculation method you have selected, and the accuracy of your device clock. The Company cannot be held responsible for possible deviations. For precise times, we recommend checking local religious authority sources.

9.2. Holy Quran Text

The Holy Quran text presented in the App is sourced from widely accepted Mushaf editions. While utmost care is taken for accuracy, the Company cannot be held responsible for any potential typographical or technical errors. If you notice an error, please report it to help@ezanvedua.com.

9.3. Translation

The Turkish translation provided is based on the Presidency of Religious Affairs (Diyanet) translation. A translation is an interpretation-based rendering and not a literal equivalent of the Quran's meaning.

10. Community Guidelines

When using community features (dua requests, group khatm, Vefa memorials, Bereket reviews, family network):

• Be respectful to other users.
• Share genuine and sincere content.
• Avoid sharing personal information (phone numbers, addresses, etc.).
• Do not post commercial advertisements or promotions.
• Be mindful of religious sensitivities.
• You can appeal content moderation decisions by contacting help@ezanvedua.com.

11. Limitation of Liability

11.1. Service Provision

The App is provided "as-is" and "as-available." The Company:

• Does not guarantee that the App will operate uninterrupted, error-free, or securely.
• Does not guarantee the App's fitness for a particular purpose.
• May temporarily suspend service for maintenance, updates, or technical reasons.
• Reserves the right to terminate the App entirely (reasonable advance notice will be given in such cases).

11.2. Damage Limitation

To the maximum extent permitted by applicable law, the Company shall not be liable for any direct, indirect, incidental, special, or punitive damages arising from the use or inability to use the App. This limitation specifically covers:

• Damages resulting from incorrect prayer time calculations
• Consequences of decisions based on AI responses
• Data loss (due to technical failure, device change, etc.)
• Interruptions of third-party services (Supabase, Apple, Google)

12. Agreement Changes

We reserve the right to modify this Agreement with prior notice. For significant changes:

• An in-app notification will be sent.
• The effective date of the change will be set at least 15 days in the future.
• If you do not accept the changes, you may stop using the App and delete your account.
• Continuing to use the App after the changes take effect means you accept the updated terms.

13. Account Deletion and Termination

13.1. By User

You can permanently delete your account and all your data at any time from Profile > Account > "Delete My Account." This action is irreversible.

13.2. By Company

In case of significant violation of this Agreement, your account may be suspended or deleted. In such cases, refunds for existing premium subscriptions are subject to Apple or Google's refund policies.

14. Dispute Resolution

14.1. Governing Law

This Agreement is subject to the laws of the Republic of Turkey and shall be interpreted under Turkish law.

14.2. Jurisdiction

Istanbul Courts and Execution Offices shall have jurisdiction over disputes arising from this Agreement.

15. Apple / Google Platform Provisions

15.1. Apple App Store

This Agreement is entered into between you and the Ezan ve Dua Development Team; Apple Inc. is not a party to this Agreement. Apple assumes no warranty, support, or liability for the App. Apple's third-party beneficiary rights are reserved. For Apple's terms of use: https://www.apple.com/legal/internet-services/itunes/

15.2. Google Play Store

Google LLC is not a party to this Agreement. For Google Play's terms of service: https://play.google.com/about/play-terms/

16. General Provisions

16.1. Severability

If any provision of this Agreement is found invalid or unenforceable, it shall not affect the validity of the remaining provisions.

16.2. Waiver

The Company's failure to exercise or delay in exercising any right under this Agreement shall not constitute a waiver of that right.

16.3. Entirety

This Agreement, together with the Privacy Policy, constitutes the entire agreement between the parties regarding the use of the App.
